Code Enforcement in the City of Weston is provided to promote, protect and improve the health, safety, and welfare of the citizens of the City. Code Enforcement Officers have the primary duty to enforce various ordinances and codes and may initiate enforcement proceedings before the Special Magistrate. In all cases, voluntary compliance is the foremost goal where code violations exist. Notification of Code Violations are issued pursuant to State Statutes 162.12.

There is a simple solution to maintaining good neighborhoods -- Individual Property Owner Responsibility. Unfortunately, some people are not responsible owners. That is why government creates minimum standards for housing, yards, parking, etc. These standards protect surrounding property owners and tenants, who might otherwise suffer from substandard conditions.

The Property Checklist below is designed to help you evaluate your own property. Please review this information and take steps to be a Responsible Property Owner.

CHECK YOUR PROPERTY


Structures

Repair rotted wood, broken or missing boards, siding or shingles and make all exterior parts weather tight, rodent proof and sound. Exteriors must be resistant to water and be covered with paint, siding, or brick that is in good condition. Inspect:
  • exterior walls
  • roof parts including rafters, soffits, fascia
  • roof covering
  • railings on stairs, elevated landings and porches
  • fences (should be in good repair and legal height)
Keep housing safe, sanitary, in good repair and sound condition. Inspect both interior and exterior:
  • walls, ceilings, floors
  • plumbing pipes and fixtures
  • windows and screens
Make sure that:
  • garbage is properly disposed of.
  • there are no areas where stagnant water collects and breeds mosquitoes.
Yard Maintenance
  • Mow the lawn.
  • Edge or remove growth from sidewalks, curb lines, gutters.
Bulk Trash
  • The City has a free quarterly Bulk Trash Program for residential customers. Bulk trash information is available by calling (954) 385-2600.
  • Place bulk trash on your curb or swale no more than 24 hours in advance of your regularly scheduled pickup day during the Quarterly Pickup Schedule.
Storage
  • Store furniture, building materials, junk, disabled or untagged automobiles, refrigerators, freezers and auto parts inside of a legally constructed, fully
    enclosed structure.
  • No trailers, boats or habitable motor vehicles of any nature shall be parked or stored on any property unless in a fully enclosed garage, except temporarily for routine cleaning, loading or unloading.
Paving / Parking
  • Driveways, steps, sidewalks and other paved areas must be in good repair and
    free of debris.
  • No vehicles shall be parked on front, side, or rear lawns when visible from any adjacent street or neighboring property.
  • Vehicles may park on swales within the public right-of-way, in the direction of traffic, provided that vehicles shall not block access to driveways, and shall not be parked on or across sidewalks, or over a catch basin.
  • Commercial vehicles shall not be parked or stored on any property unless in a fully enclosed garage.  They may be temporarily parked throughout the day during periods of approved construction permitted by the City's Building Dept. or when being used for pick-up, delivery or the furnishing of commercial services.
Business Activities
  • Home occupations (any business conducted from your home) must be properly licensed with a Business Tax Receipt (BTR) and must meet strict criteria. No traffic or outside display may occur and the occupation must be clearly secondary to the use of the property as a home. Call City Hall at 954-385-2000 for BTR information/application.
CODE COMPLAINTS

A citizen can report a complaint by calling the Code Enforcement Division at 954-385-4570. If it is determined that a violation exists, the inspector issues a notice of violation.

IN BRIEF, THE PROCESS IS AS FOLLOWS

1. If a violation is alleged to exist, written notice is provided to the violator of the violation and affords that person a reasonable time, dependent on the nature of the violation, to correct it. If the violation is corrected, the process ends here.

2. If the violation continues beyond the time specified for correction, the violator is scheduled for a hearing before the Special Magistrate. Written notice is provided to the violator. Special Magistrate Hearing procedures are outlined in City Code 33.21. The Clerk for the Special Magistrate can be contacted at 954-385-0500. Hearings are held at Weston City in the City Commission Chambers, 17200 Royal Palm Boulevard.

3. The Special Magistrate may require the violator to pay a fine, not to exceed $1,000 per day, for each day that the violation continues past the date set in the order for compliance. In the case of a repeat violation, the Special Magistrate may order the repeat violator to pay a fine not to exceed $5,000 a day, for each day the repeat violation continues past the date of notice of the repeat violation. Upon a finding that the violation is irreparable or irreversible in nature, the Special Magistrate may order the violator to pay a fine not to exceed $15,000 per violation. In addition to such fines, the Special Magistrate may impose additional fines to cover all costs incurred by the City in enforcing its Codes and all costs or repairs.

Special Magistrate
In the City of Weston a Special Magistrate hears those matters that he/she is empowered and authorized to hear and rule upon, under Florida Statutes Chapter 162, for violations occurring within the city. The Special Magistrate has the authority to impose administrative fines and other non-criminal penalties in addition to the implementation of supplemental code enforcement procedures, to provide an equitable, expeditious, effective, and inexpensive method of enforcing any codes and ordinances in force in the City where a pending or repeat violation exists.
